Do you have to rent to a Sex Offender?


There has been a lot of confusion and opinions on the subject for years. Both private landlords and property management companies strive to uphold fair housing laws at all times and some have been afraid that denying to rent to someone who would qualify otherwise on the grounds that they were a sex offender would put them in violation of fair housing. This is not true.


On the U.S. Department of Justice website, it states: “Current users of illegal controlled substances, persons convicted for illegal manufacture or distribution of a controlled substance, sex offenders, and juvenile offenders are not considered disabled under the Fair Housing Act, by virtue of that status. The Fair Housing Act affords no protections to individuals with or without disabilities who present a direct threat to the persons or property of others.
